about four hours thereafter. Andrew Shenits who worked with him had
his leg broken by the same fall. They were engaged in trimming up their
place after a full cut of coal five feet in depth had been taken out, and
had failed to take down or post the slate. Novartney had been warned
as to the dangerous condition of the slate, and was requested to take it
down by Alex Krow, a machine man, shortly before the accident occurred, but
Novartney examined it and insisted that it was safe.) |

(John Novartney, machine loader, was so seriously injured by a fall of slate
in No. 34 room off No. 10 butt entry left, in the Salem Mine that death resulted
about four hours thereafter. Andrew Shenits who worked with him had
his leg broken by the same fall. They were engaged in trimming up their
place after a full cut of coal five feet in dept had been taken out, and
had failed to take down or post the slate. Novartney had been warned
as to the dangerous condition of the slate,and was requested to take it down
by Alex Krow, a machine man, shortly before the accident occurred, but Novartney
examined it and insisted that it was safe.)
