forcing it on to the machine board. Bendido was caught between the
mine car and machine. Had the loader closed the switch as he should
have done, the accident would not have happened, in the Ernest No. 1 Mine,

Rellic, another miner, were sent to No. 18 room in No. 4 heading by the assistant
foreman. The heading men had not worked in this heading for two or three
days. They had cut through a clay vein some distance from the face of the
heading and some roof had fallen close to the clay vein leaving a cavity.
A small body of gas must have accumulated in this cavity and when he and
Rellic went toward the face of the heading their lamps must have ignited
the gas as Rellic was found in the back heading burned and Groush was found
dead on the floor near the clay vein, probably having been suffocated by
the afterdamp that was given off from the explosion of gas.)

OHara, Fire Boss at Ernest No. 2 Mine of the Jefferson and Clearfield
Coal and Iron Company, for neglect of duty. At the hearing before the Hon.
S.J. Telford, Judge of the Indiana County court, the defendant appeared and
admitted the fact of official delinquency charged against him. The Court
found that on May 30, 1910, the defendant had signed a report, certifying
that he had made an examination of the mine as his duty required him to do,
without in fact having made any such examination. The Court directed the
Clerk of Court to notify the Examining Board of the Twelfth Bituminous District
of the finding, and that said Board be instructed to withdraw the certificate

Watson, Fire Boss at Ernest No. 2 Mine of the Jefferson and Clearfield Coal
and Iron Company, for neglect of duty. At the hearing before the Hon. S.J.
Telford, Judge of the Indiana County court, the defendant appeared and admitted
the fact of official delinquency charged against him. The Court found that
on May 30, 1910, the defendant had signed a report, certifying that he had
made an examination of the mine as his duty required him to do, without in
fact having made any such examination. The Court directed the Clerk of Court
to notify the Examining Board of the Twelfth Bituminous District of the finding,
and that said Board be instructed to withdraw the certificate of the defendant
until the first day of March, 1912. With John OHara.)
